WAIVER AND RELEASE OF LIABILITY FOR THE

All participants agree to the terms and conditions of the following release of liability:

ASSUMPTION OF RISK

I UNDERSTAND, AGREE, AND ACKNOWLEDGE THE FOLLOWING:

1. I am familiar with the risk of serious injury and death which any participant in this program must assume,
2. I believe that I am physically, emotionally, and mentally able to participate in this program and that my equipment is mechanical fit for my use in this program,
3. I understand that all applicable rules for participation must be followed and that at all times the sole responsibility for my personal safety remains with me,
4. I understand that alcohol is served and consumed on this property and agree to consume alcohol responsibly so as to avoid danger to myself and others,
5. I will immediately remove myself from participation and notify the nearest official if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that I have experienced any deterioration in my physical, emotional, or mental fitness for continued participation in this program.

WAIVER OF LIABILITY, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

On behalf of myself, my heirs, assigns, personal representatives, and the next of kin, all risks associated with participating in this program, I HEREBY RELEASE Axaholics LLC FROM ANY AND ALL LIABILITY. I further state and acknowledge that:

1. I unequivocally assume all risks associated with participation in this program by me regardless of negligence or for gross negligence including any compounding or aggravation of injuries caused by negligence by the negligent rescue operations or procedures in the program organizer and any person associated therewith or participating therein,
2. I unequivocally assume all risks associated with the consumption of alcohol of not just myself, but any and all other participants on this property.
3. I knowingly and voluntarily agree to a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY for the program organizer and all persons and organizations associated with it in the program including without limiting the generality of the foregoing its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/or lessors of the premises used to conduct the program, sanctioning bodies, medical or rescue personnel (“the Releasees”) of and from with respect to all injury, disability, death, or loss or damage to person or property whether arising from negligence or negligent rescue of or by the foregoing or otherwise,
4. I understand and agree not to sue the releases for any loss, injury, cost, or damages of any form or type howsoever caused or arising from either directly or indirectly from the participation in this program by me,
5. I AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees and each of them from any litigation expense, legal fees, liability damage award or cost or any form or type whatsoever that may incur due to any claim made against them or any one of them whether the claim is based on the negligence, the gross negligence of the Releasees or otherwise.

RESPONSIBILITY FOR ALL DAMAGE TO PROPERTY

I hereby agree to pay for any and all damages done to the facility or equipment, or anything on the premise of Axaholics LLC. I further give the Axaholics LLCpermission to charge my previous form of payment used for my reservation if applicable or I will settle any and all damage amounts prior to leaving the facility.

AUTHORIZATION AND COPYRIGHT OF LIKENESS AND IMAGE

1. In the event that Axaholics LLC, takes photographs or videos, I hereby assign full copy rights of these photographs and videos to Axaholics LLC., and their related representatives and assigns (together with the right and reproduction either wholly or in part). Furthermore I Axaholics LLC the perpetual and irrevocable and understood right to use and publish video and/or photographs of me where I may be included for editorial trade, product, or service advertising and such other fashion/business purposes in any manner and medium, including advertising with any retouching or alteration without restriction or compensation.

I HAVE READ THIS DOCUMENT THOROUGHLY.
I UNDERSTAND THAT THE RELEASEES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY PARTICIPATION IN THIS PROGRAM.
I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I GIVE UP SUBSTANTIAL LEGAL RIGHTS I WOULD OTHERWISE HAVE.
I HEREBY SIGN THIS DOCUMENT VOLUNTARILY, KNOWINGLY, AND WITHOUT COERCION, THREAT OR INDUCEMENT.
